PROVISIONS
TO TAKE PLACE WITHIN THE PRINCIPAL AGREEMENT
A Compulsory Provisions:
Article - 4 : It is compulsory for including the provisions regarding the following conditions within the principal agreement ofthe cooperative: 1- The name and headquarters ofthe cooperative, 2- The objective and working subjects ofthe cooperative, 3- The states and conditions that result in the gain or loss of the partnership position. 4- The amount of partnership shares and the form of payment of the cooperative capital, the necessity of cash payment of at least one fourth ofthe cash capital, 5- Whether or not the partners are required to deposit capital in kind, 6- The state and liability of the partners as a result of the undertakings of the cooperatives, 7- The duties, authorities and responsibilities of the administrative and auditory organs of the cooperative and the methods of election, 8- The provisions regarding the representation ofthe cooperative, 9- The calculation and usage methods for the aýmual income -expenditure differences, 10- The names, sumames, business and home addresses of the founders. II- Optional Provisions: Article - 5 : The principal agreement may also cover the following conditions: 1- The provisions regarding the meeting ofthe general assembly, the taking ofthe decisions and the casting ofthe votes; 2- The principles regarding the form of working of the cooperative; 3- The relations ofthe cooperatives with the unions; 4- The provisions regarding the unification ofthe cooperative with another cooperative; 5- The period ofthe cooperative. Commentary Provisions: Article - 6: In case there exists no provisions in the principal agreement regarding the conditions written in Items 1 and 2 of Article 5, the following provisions are applied: 1- The general assembly is called for a meeting through registered letters signed by those authorised to represent the cooperative or local newspapers or through written notification against signatures in the villages. 2- The activity ofthe cooperative is limited with the objective and working subject ofthe cooperative. |
