PERMISSION;
REGISTRATION AND ANNOUNCEMENT Article
- 3 : A The principal agreement is submitted
to the related Ministry.Upon the granting ofpermission to the institution
by the Ministry, the location of the cooperative headquarters is registered
within the commercial registry aýýd is announced. The conditions to
be registered and announced are given below:
1- Date ofthe principal agreement, 2- Objective, subject and period (if any) of the cooperative, 3- Title and headquarters ofthe cooperative, 4- Capital of the cooperative and minimum amount of payment realised against the cash portion of this and the value of the share of each partnership, 5- The fact that the names are written on the partnership share documents, 6- The capital in kind and the valuable assets taken over, the constituents ofthe plants and their values, 7- The form ofrepresentation and auditing ofthe cooperative, 8- The names and sumames of the members of the board of directors and the persoýmel authorised to represent the cooperative, 9- The form ofthe announcement to be realised by the cooperative and the form of notification of the shareholders regarding the decisions of the board of directors, if there exists a provision on this subject within the principal agreement, 10- Branches of the cooperative: If they deem necessary, the cooperatives can open branches both within and outside the country. The branches are registered m the commercial registry where they are located, by refemng to the registry records of the centre.The related Ministry cannot abstain from pennitting the establishment of the cooperative by putting fonvard that the principal agreements are deviating from the optional provisions ofthe law.The modifications of the principal agreement are dependent on the methods at the institution. |
